(l) Employment of related persons in a single organizational unit or in job-related organizational units is permitted, provided that such employment will not involve a conflict of interest, including but not limited to participation by the relative in making recommendations or decisions specifically affecting the appointment, retention, tenure, work assignments, evaluation, promotion, demotion, or salary of the related person. The president or president's designee shall determine, prior to employment of related persons, that a conflict of interest will not occur.
(2) "Relatives" or "related" persons are those related to each other in one of the following ways: husband; wife; parent; child; brother; sister; or spouse of a child, brother or sister.
For Faculty--When faculty appointments covered by the Board of Regents policy on the employment of relatives appear necessary, prior to making the appointment, the department chairman, through the appropriate dean, shall submit to the Dean of the Faculties a memorandum justifying the proposed appointment in order that approval for the appointment may be sought from the President. The appointment may be made only upon the notification of the approval of the President.
For Administrative and Professional Staff--Administrative and Professional personnel, as provided in the following paragraph, will not be employed in a position that is superordinate or subordinate to a position held by a familial relative;. A familial relative, for purposes of this policy, is defined as a person who is immediately related to another person by blood or marriage; this includes brothers, sisters, children, husbands, wives and parents. In the event that other qualified persons cannot be found after a reasonable effort has been made to fill a position, a qualified individual may be appointed to a position, that is superordinate or subordinate to a position that is held by a familial relative. Prior to accomplishing the appointment, the employing department head must submit to the Director of University Personnel Relations a memorandum which indicates the period of time the position has been unfilled, the means used to advertise its availability, the number of applicants interviewed for the position, the name of the prospective appointee, the name of the familial relative, the type of familial relationship (husband, wife, et al.) and an organization chart showing the superordinate or subordinate relationship involved. The appointment may be made only upon receipt of written approval from the Director of University Personnel Relations.
